Defense Claims Unlawful Arrest In Sexual Assault Case

TECUMSEH – The defense attorney in a Johnson County rape trial is asking the court to bar evidence obtained after the arrest of his client, 32-year-old Luke Anderson of Syracuse.

Attorney Korey Reiman says sheriff’s deputies received a complaint on May 7 and went to Anderson’s place of employment two hours later and arrested him.

The attorney says it is unclear if law enforcement conducted any investigation of the complaint, but said the arrest was made without a warrant and in violation of Anderson’s rights.

He is asking the court to ban any statements Anderson made or any evidence obtained from him.

A suppression hearing is set on Feb. 4.
